The United States Court of Appeals for the Second Circuit has overturned the dismissal of Sarah Palin’s defamation suit against The New York Times Company.
In its Opinion issued August 6, 2019, the Second Circuit held that the district court erred in relying on facts outside the pleadings to dismiss the Complaint. The court further concluded that Gov. Palin’s “proposed Amended Complaint plausibly states a claim for defamation and may proceed to full discovery.”
Kenneth Turkel, in a joint statement with appellate counsel Libby Locke, said: “This is — and has always been — a case about media accountability. We are pleased with the Court’s decision, and we look forward to starting discovery and ultimately proceeding to trial.”
